Bail revoked for Updyke in Auburn tree poisoning case

OPELIKA, Ala. (AP) — A judge has revoked the bail of a University of Alabama fan accused of poisoning Auburn University's landmark oak trees.

Officers hand-cuffed Harvey Updyke and took him to jail after the ruling today by Circuit Judge Jacob A. Walker III in Opelika.

Walker granted prosecutors' request to jail Updyke after watching a video of his arrest after a confrontation with store employees at a Louisiana home improvement store in September.

The defense argued that Updyke should remain free because the arrest was improper.

The judge said Updyke violated terms of his bail by getting arrested and notes that Louisiana still has an arrest warrant for him.

Updyke is set for trial April 8 on charges that include criminal mischief.

The university says the trees are all but dead and will be removed.

This case is proof positive that the system is broken. How long has this case drug on?

I think they should move the trial to Tuscaloosa. I have not met a Bama fan yet that is not sickened by this. I think he would suffer a greater fate as folks there would make an example out of him.

Ok I'm an Auburn fan But why did the AP start out saying "University of Alabama fan Harvey Updyke" [Sic] Because that suggest that he Updyke was doing this in the name of Alabama, Which I and many other Auburn and Alabama fans alike know he didn't do this in the name of Alabama he did this for his personal reasons.

The AP should have said Harvey Updyke and his lawyers are in court.

Get over it....they are trees! There are much worse things happening in society for this to be news worthy.

they should ball & chain him and make him dig up the Dead Trees!

Updyke should be punished accordingly for what he did, the truth is these trees were already dying long before Updyke came along.
