HUNTSVILLE (AP) — A Huntsville woman says in a new lawsuit that she became ill after eating a moldy Mr. Goodbar candy bar that she claims was nine months beyond its expiration date.
Al.com reports that Terrica Brown is suing Walmart and the Hershey Co. Brown says she was working at the a Walmart store on South Memorial Parkway in Huntsville on Feb. 28, 2011, when she ate the candy bar while on a break from her job.
The lawsuit states that Brown did not know the candy bar had an "expiration or sell by" date of May 10, 2010.
The lawsuit was filed this week in Madison County Circuit Court.
Messages sent to Walmart and the Hershey Co. from al.com seeking comment were not immediately returned.

I wonder which esteemed plaintiffs attorney is representing Ms Brown. Lawsuits cost our country 260 billion dollars in 2010 according to Towers Watson. To put in another perspective this number represents 850 dollars we each paid that year as a "tort tax" or 1.8% of our gross domestic product. If we instituted "loser pays" system as a country then this kind of lawsuit would come to a quick end.

I would contend that she didn't know it was molded until after test of her sickness showed that. Sorta like if someone eats a hamburger gets sick and then it was determind it contained E-Coli, or eating a Peanut butter sandwich and it has Salmonella these are things not known until it has been consumed.
Quoting stats about law suits in no way should be interupreted as being of a criminal nature. Persons who have suffered a loss are entitled to be made whole.
Is it possible that the candy bar had been in her possession for some time sure, However if she produces a receipt that it was purchased prior to eating then the bar code will also show the batch # on the product which would elimanate the criminal aspect.

I assume and I use that word lightly that her stomach contents were tested, It does sound extream however if they thought they could be dealing with a mass contamination then perhaps that would be protocall. Today you have got to have some kind of substantial evidence for your claim just a mere threat to sue and shake down a company today doesn't really work.
Who know's she may only be asking for a nominal amount, We wern't informed of that.
