A judge has dismissed charges against Oakland Raiders linebacker Rolando McClain.
Court documents show that Morgan County Circuit Judge Steven Haddock dismissed the charges this month after McClain's accuser told prosecutors he no longer wanted to pursue the case.
Decatur Municipal Judge Bill Cook convicted McClain in May of third-degree assault, menacing, reckless endangerment and discharging a firearm in the city limits. Cook sentenced McClain to 180 days in jail for allegedly threatening to kill a man and firing a gun next to his head.
McClain's lawyer, Harvey Steinberg, appealed.
McClain later apologized for bringing bad publicity to the team.
McClain was the eighth overall pick in the 2010 draft after helping lead Alabama to a national title. He won the Butkus Award as the nation's top linebacker.

Was the case dismissed before the election?
You would think that a voice of the people like we have in the DAILY would have found that important.
He simply gave the man some CASH!!!. That's all he wanted in the first place.
I thought that being charged with discharging a firearm inside city limits was something that the city pursued and was not up to the accuser to drop. Am I wrong about that? I am starting to learn more and more that the problem is not with the laws we have, the problem is with them not being enforced.
@Calhoun I may not always agree with you but this time I do I didn't think that a accuser could simply say I don't want to pursue this. I think the peolpe need to be reinbursed after all it was our dime when he want to pursue it. If we continue this every body that wants to harass someone using the counties coffers will certainly do so. This also proves that city court has no bite.
@Casinokid. Could not have said it better. And YES, we (citizens) need to be reimbursed for every single dime that was spent on this case. But I am still questioning that someone can say " . .Nah, I'm done with this case and do not want to pursue it anymore", can negate a decision from a Judge. If the victim does not want to pursue further in Civil court, then it should revert back to Municipal court whee a sitting Judge found Rolando guilty and sentenced him to jail. I guess money does talk. Regardless, the taxpayers are the ones who paid the price for all this. Sad.

I just read the followup article. Tapscott filed the charges not Decatur PD so if he decides to withdrawn the complaint it all goes away . . . even the Municipal court proceedings. It it just all magically erased and he has no conviction on his record. I guess the law was followed and played out as our courts deemed correct but . . . . . damn.
That doesn't mean the DPD could not have filed any charges. Of course, if the complaintant refuses to testify, we spend money for nothing. DPD could potentially prosecute the "victim" here, but to strike against this atmosphere of thuggery someone has decided that efforts and money are best spent elsewhere.
Can't believe he got away with it. Prosecute the victime for what exactly? Charles, your post doesn't make any sense.
