James, I agree that it would be much easier for the state to forego all these silly "constitutional rights" and just execute accused criminals on the spot without a trial. However, until We The People amend the constitution to do away with those provisions I guess we're stuck with having defendants receive the right to legal counsel, the right to confront his accusers, the right to a trial by a jury of his peers, and a presumption of innocence until the state meets its burden of proving him guilty beyond a reasonable doubt. These rights are there to protect EVERYONE and ensure that if the government seeks to deprive anyone of their life, liberty or property that they give due process to those parties. The 12 citizens of Lawrence County sitting in that jury box are the ones in the best position to determine the facts of this case. They're listening to this testimony and seeing all the exhibits and they will be able to separate the facts from the nonsense. Look, I agree that this guy is a slimeball and his whole 8 y.o. wanted to defense is bunk. But the prosecution will be able to refute that and jury will be able to recognize that based on the evidence and testimony presented. And as for the defense attorney, he is sworn to zealously represent the interests of his client and make sure that his client is afforded all his constitutional safeguards. It's not the defense's job to prove innocence, it's the prosecution's job to prove guilt and it sounds like they're well on their way to doing that. Despite all its flaws, we have the best criminal justice system in the world. Just have a little faith that they'll get this one right.

PS- I agree that Aggravated Child Rape should be a capital offense. It's a shame that last year our Supreme Court in Kennedy v. Louisiana trampled over state sovereignty and stretched the 8th Amendment so far beyond its original meaning that it is barely recognizable. We need our appellate courts to decide law, not make up policy.

This is my niece, my brothers child, that this story is about and the sick scum of a animal that did this was her uncle. He told all lies on the stand and everything he told was a lie. Her parents never never left her nor her brother over there at her grandparents house for weeks on end, nor did she watch her grandparents have sex nor watch videos. They went to thier grandparents house on Saturday and went to church on Sundays. Nor did she have a bathroom problem. In my opinion when this article was written, maybe her family should have been asked if this was true before being printed. There is this person on the stand telling lies saying a 8 year old was trying to have sex with him, you know that is a lie so what made anybody think he told any truth at all.

Remember this child is only 8. I don't think an eight year old can lie like that. He is an adult he knows better and if he doesn't he needs to be locked up some where so he can not do this again. We need to care about the child's rights and not the right of someone that would even think about doing this to a baby. And YES she still is a baby.

The parents should also be held accountable...and the child taken out of that home. There is no supervision or concern for where they leave their child when that are out partying, the grandparents having sex where she can see them, and adult videos!! This is my point, the stories he told on the stand are NOT TRUE! The parents did and do not party and the grandparents did not have sex in front of her and she DID NOT see any videos. Her grandparents, the grandfather was bedridden with hospital bed in the living room. He was terminally ill and later died, he was not able to talk or get out of the bed, could not move, so the stories this person told were not true, and the paper had no right to print something they did not know was true.

GIve him his trial, as dictated by law, then give him his verdict. He'll be in prison soon enough.

Mary, my heart goes out to you and your family. I can't imagine how violated (privately and publicly) you all must feel. My hope is that the paper only REPORTED what was stated in testimony. That is their job. Most thinking people are keenly aware that there are individuals in society with no regard for the law, period. (That includes, lieing under oath.)

I am the mother of this child and me now her father ever went out and partied. I wish they would not have printed that story wothout telling us first. That was my half brother that did that to her and she had her innocence taken from her. I love my children very much and would love to see that court try and take my kids from me because of this. It was not my daughters fault it was this sick mans fault.
